Abstract
In the various countries of the European Community, those exercising the Treaty-based economic freedoms (movement of goods, persons, services and capital) are confronted with rules that restrict the aforementioned freedoms. The author of this article seeks to answer the question of what the autonomy of the Member States currently looks like in terms of business rationing. The author discusses the principle of non-discrimination and proportionality. The author confronts the national legislation with the above-mentioned freedoms and cites the interpretation of the treaty provisions by the European Court of Justice.
