Abstract
As can be seen from the deliberations concerning the English land law, one property can be subject to many different rights vested in different entities, while still remaining the property (ownership) of the Crown, which is a characteristic feature of English (and Welsh) land law. As an example, it can be pointed out that one property can be subject to the following rights:
1) a fee simple vested in Amy;
2) a lease granted to John by Amy for a period of 99 years;
3) a tenancy granted to Louis by John for a period of 1 week;
4) a legal mortgage established on a freehold by Amy in favour of a developer;
5) an equitable mortgage established on the 99-year lease by John in favour of his bank;
6) a right of way vested in David;
7) a rent charge established by Amy in favour of her neighbour Eric to secure Amy's participation in the cost of maintaining the shared driveway to the property; and
8) the rights arising from a restrictive covenant, which prohibits the use of the property for business.
This paper presents only an outline of the concept of property rights under English Land Law, which is so different from the property law known to the legal systems of continental European countries.
