Abstrakt

Autor artykułu porusza zagadnienia dotyczące podstawowych gwarancji prawidłowo funkcjonującego wymiaru sprawiedliwości jakim jest kontrola sądowa nad czynnościami dokonywanymi w postępowaniu przygotowawczym. Autor omawia regulacje prawne w kontekście zmian wprowadzonych nowelizacją Kodeksu Postępowania Karnego. W artykule przedstawiono przepisy regulujące kontrolę sądową nad stosowaniem tymczasowego aresztowania, kontrolę warunkowo umorzonego postępowania przygotowawczego, kontrolę w ramach przygotowania do rozprawy głównej oraz w postępowaniu przed sądem I instancji. Autor w swojej pracy przytacza orzecznictwo polskich sądów w tej materii oraz poglądy doktryny.

 

The author of this article raises issues that concern the basic guarantee of a properly functioning justice system, namely judicial control of the actions carried out in pre-trial proceedings. The author discusses legal regulations in the context of changes introduced by the amendment to the Code of Criminal Procedure. The article presents provisions regulating judicial control of the use of pre-trial detention, control of conditionally discontinued pre-trial proceedings, and control of preparations for the main hearing and in proceedings before the court of first instance. In this work, the author cites the rulings of Polish courts in this matter and the views of the doctrine.
