Abstrakt
Autorzy artykułu przedstawiają stan gospodarstw spadkowych w wybranych powiatach przed wprowadzeniem zmian w kodeksie cywilnym z 1971 r. oraz przed wydaniem ustawy o uregulowaniu własności gospodarstw rolnych, także z 1971 r. Badania dotyczą gospodarstw spadkowych, których właściciele zmarli po 5 lipca 1963 r., tj. pod rządem przepisów o ograniczeniu podziału gospodarstw rolnych. Gospodarstwa podzielono na dwie grupy, w którym kryterium było obowiązywanie bądź brak ww. przepisów ustawowych. Autorzy artykułu próbują ustalić, czy gospodarstwa są użytkowane w całości przez spadkobierców, czy też uległy podziałowi. Badanie tej materii pozwala na ocenę czy przyjęte w nowelizacji kodeksu cywilnego przepisy, spełniły swoje zadanie.
The authors of the article present the status of inheritance farms in selected poviats before the introduction of the amendments to the Civil Code of 1971 and before the issuance of the 1971 Act on the Regulation of Farm Ownership. The research concerns inheritance farms, the owners of which died after 05.07.1963, i.e. under the government of the provisions on the restriction of the division of farms. Farms were divided into two groups, where the criterion was whether or not the above-mentioned statutory provisions were in force. The authors of the article try to establish whether the farms are used entirely by the heirs or whether they have been subdivided. The analysis of this matter makes it possible to assess whether the provisions adopted in the amendment to the Civil Code, have served their purpose.
