Abstract

The article analyzes mediation in clinical and bioethical disputes in the United States, using Pennsylvania as a leading model. It examines legal and institutional tools – mediation confidentiality, the MCARE fund, mandatory settlement conferences, and pre-suit programs – that enable timely, consensual resolution of conflicts over informed consent, medical malpractice, and clinical research. Barriers include fragmented regulation, lack of uniform mediator certification, and a weak settlement culture. The paper proposes a UMA-plus package: national confidentiality standards, strengthened apology laws, and incentives for healthcare providers.
