Abstract
The author of the article familiarises the readers with the institution of the complaint occurring in the Polish criminal process. He presents the current state of the law in Poland, focusing on the problems of systematics and the issue of the subject of the complaint, quoting the motives of the Codification Commission, which was responsible for the creation of the Code of Criminal Procedure, as well as the case law of the Supreme Court. The analysis is accompanied by a brief historical and comparative overview, a description of the more relevant laws of capitalist countries such as France, Switzerland, Germany or South American countries. In addition, the author presents the laws of socialist countries such as the USSR, Bulgaria, Czechoslovakia, East Germany and Hungary.
