Abstract
Marxists divided manufactured goods into means of production and means of consumption. Where, in an ideal communist state, the former would be socially owned, while the means of consumption would be allocated to the ownership of individual members of society. However, the law of socialist countries does not contain regulations on the transition period covering the transformation from a capitalist to a communist system. The author of the article characterises the institutions of personal property in the legal system of socialist countries. He outlines the constitutional regulations of the USSR and the People's Republic of Poland in this area. The social functions and development prospects of the institution are described. The author discusses the scope of personal property in light of the provisions contained in the Constitution of the People's Republic of Poland and the Civil Code. Furthermore, he characterises the distinct legal regime for social property in the context of personal property and also describes the difference between the institution of personal property and personal property.
