Abstract
The 1958 Constitution of France, although enacted after France had already ratified the founding treaties of the European Communities, did not provide for any specific regulations relating to membership of international organisations of this type. Until 1992, France's participation in the Communities was based on general constitutional provisions, in particular paragraph 15 of the preamble to the 1946 Constitution.The 1992 constitutional reform brought fundamental changes in this respect. Even though it regulated numerous issues, the reform did not introduce any provisions concerning venue as well as the validity and applicability of community law in the French internal legal system. These issues are dealt with under the provisions of international obligations of all types. In turn, a number of issues are subject to constant interpretation by the courts, among which the Court of Cassation, the Constitutional Council and the Council of State play a crucial role.
It is noteworthy that, despite the principle of the primacy of community law over national law established through the case-law of the European Court of Justice, in France, the view of the supremacy of the constitution over any legal norms in force in the state seems unassailable. Even the principle, expressed explicitly in Article 55, of the primacy of international agreements over laws, only gained complete understanding with the end of the 1980s.
