Abstrakt

The author considers historical and epistemological issues concerning such a theory of law which can be integrated with the Marxist theory. The work quotes sceptical arguments against attempts to transform philosophy of law into social engineering and proves that science can be verified by means of analyzing statements in relation to the truth comprised in them and norms in relation to justice.
In the author’s opinion materialistic and dialectic theory of law cannot disregard any of the three aspects of law: genetic, structural and functional. The author says that the implementation of this type of research is obstructed by excessive expansion of logical and structural aspects. Materialistic unity of logical and historical aspects is a methodological precondition for the theory of system. The author understands it as a relation between real historical aspects, real logical aspects and ideal historical and ideal logical aspects.
