Abstrakt
Autor artykułu kładzie nacisk na problem faktycznego funkcjonowania instytucji kolegiów karno-administracyjnych przy prezydiach rad narodowych. Autor dokonał analizy akt spraw z roku 1965, które zakończyły się wydaniem prawomocnego orzeczenia, obserwował rozprawy toczące się w kolegiach w roku 1966, przeprowadzał wywiady z przewodniczącymi kolegów, właściwych prokuratur oraz komend MO oraz badał warunki i organizacje pracy kolegiów. Celem pracy jest przedstawienie istniejącej w kolegiach praktyki oraz stwierdzenie jak kolegia karno-administracyjne interpretują obowiązujące przepisy oraz w jaki sposób rozwiązują sytuacje, które nie są precyzyjnie uregulowane.
The author of the article emphasises the problem of the actual functioning of the institution of criminal-administrative collegium at the presidiums of national councils. The author analysed the files of cases from 1965 that ended in a final verdict, observed the trials held at the collegiums in 1966, interviewed collegium presidents, the relevant prosecutor's offices and the Civic Militia stations, and studied the conditions and organisation of the collegiums' work. The aim of the paper is to present the existing practice in the collegiums and to state how the criminal-administrative collegiums interpret the existing legislation and how they resolve situations that are not precisely regulated.
