Abstrakt
Głównym celem socjalistycznego prawa rodzinnego jest ochrona i umocnienie instytucji rodziny. Zasada dobra dziecka ma fundamentalne znaczenie w obecnie obowiązujących regulacjach kodeksu rodzinnego i opiekuńczego, ponieważ wyznacza określony kształt, treść i funkcjonowanie pozostałych norm kodeksowych. Autor artykułu analizuje poszczególne przepisy k.r.o., dokonuje ich wykładni oraz opisuje je w świetle zasady dobra dziecka. Przytacza także osiągnięcia polskiej doktryny oraz orzecznictwo sądów, które stanowią dopełnienie analizy.
The main objective of socialist family law is to protect and strengthen the institution of the family. The principle of the child's welfare is of fundamental importance in the current regulations of the Family and Guardianship Code, as it determines the specific shape, content and functioning of the other code norms. The author of the article analyses the various provisions of the FGC, interprets them and describes them in the light of the principle of the welfare of the child. He also cites the achievements of Polish doctrine and the jurisprudence of the courts, which complement the analysis.
