Abstrakt

W artykule zostaje poruszony temat budzący kontrowersje jakim jest sytuacja prawna odbiorcy przesyłki w świetle Kodeksu Cywilnego i Prawa Przewozowego. Autor charakteryzuje uczestników umowy o przewóz towarów, osoba odbiorcy, przedstawiona zostaje instytucja bezimiennych dokumentów przewozowych. Autor porusza kwestię związane z dysponowaniem przesyłką, zawiadomieniem o nadejściu przesyłki oraz prawie przystąpienia do umowy przewozu. Ponadto przeprowadza analizę przepisów regulujących opłacanie należności przewozowych, wydania przesyłki odbiorcy, kwestie związane z ubezpieczeniem przesyłki oraz dochodzenie roszczeń względem przewoźnika.

 

The article discusses a controversial topic, i.e. the legal situation of the consignee in the light of the Civil Code and the Transport Law. The author characterises the participants in a contract for carriage of goods, the person of the consignee, and the institution of unnamed shipping documents is presented. The author addresses issues relating to the disposal of a consignment, notice of arrival and the law on entering into a contract of carriage. In addition, it analyses the regulations governing the payment of freight charges, the delivery of the consignment to the consignee, issues relating to the insurance of the consignment and the assertion of claims against the carrier.
