Zagadnienia prawne gospodarstw rolnych zaniedbanych ekonomicznie

Abstrakt

Polska Rzeczpospolita Ludowa od początku swojego istnienia głosiła politykę należytego wykorzystania ziemi. Autor artykułu prezentuje regulacje prawne dot. zagospodarowania użytków rolnych oraz przedstawia problem gospodarstw rolnych zaniedbanych ekonomicznie. W artykule omówiono pojęcie gospodarstwa rolnego zaniedbanego ekonomicznie, zagadnienie pomocy państwa dla ww. gospodarstw, scalania zaległości oraz przymusowe przejmowanie nieruchomości rolnych na własność państwa za zaległe należności. Przedstawiono również instytucje dobrowolnego oddawania nieruchomości rolnych za rentę. Autor apeluje o uporządkowanie i kodyfikacje przepisów dotyczących gospodarstw rolnych zaniedbanych ekonomicznie.

Since the beginning of its existence, the Polish People’s Republic has proclaimed its policy of the proper use of land. The author of this article presents legal regulations concerning the management of agricultural land and the problem of economically neglected farms. The article discusses the concept of an economically neglected farm, the issue of state aid for said farms, the consolidation of arrears and the forced takeover of agricultural property into state ownership for arrears. The institutions of voluntary surrender of agricultural property for annuities are also presented. The author calls for the ordering and codification of the legislation on economically neglected farms.
