Abstract

The electoral law is one of the most important areas where the interests of constitutional lawyers, political scientists and sociologists converge. From those disciplines’ perspective, the subject matter is admittedly approached differently, but when it comes to the most important dilemmas of electoral law, their disclosure and, to an even greater extent, resolution requires the assembly of knowledge formulated by the aforementioned disciplines. The contemporary democratic theory provides for a fruitful confluence of these perspectives. It is not possible to clearly state whether it is a normative or a descriptive theory. Our problem undoubtedly begins with a normative question: what are the democratic values that the electoral law is supposed to ensure? It leads through the practical issue of the conflict of democratic values to the empirically verifiable issues of the political effects of electoral law and its impact on citizens' voting behaviour. The general coverage of these problems is a formidable task which exceeds the scope of the article. The author only picks up on some of the themes that are important in the context of the Polish electoral law. In particular, he shows that there is a strong conflict of democratic values in both the existing parliamentary election system and the one passed by the Sejm on 7 March 2001, and that some constitutional norms are only fulfilled in a very rough manner. The Polish legislator treats the electoral law extremely instrumentally - without proper rooting in the doctrine of representative government.
